These Terms & Conditions ("Terms") govern your use of evco-usa.shop and your purchase or use of products and services offered by EVCO USA. By accessing the website, creating an account, placing an order, registering a product, requesting support, or using an EVCO USA-connected service, you agree to these Terms and the related policies referenced below.
1. About EVCO USA
EVCO USA is a distributor of EV charging and supporting electrical-infrastructure products. Our product focus includes OCPP AC EV chargers, dynamic load management (DLM) and power-balancing solutions, EV charger installation kits, electrical panel upgrade kits, and related accessories and components.
Certain products sold by EVCO USA may carry third-party brand names, including EVGREEN. Unless otherwise stated in writing, EVCO USA is the seller or distributor for products purchased through evco-usa.shop and administers applicable order, return, warranty, and customer-support processes for those purchases.
evco-usa.shop is the official EVCO USA website and online store for company information, product information, purchases, policies, manuals, downloads, warranty information, returns, and customer support.
2. Eligibility and Acceptance
You must be legally capable of entering into a binding agreement to place an order or use services that require an account. If you act on behalf of a business, property owner, employer, contractor, or other organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms or an applicable related policy, do not use the affected service or place an order.
3. Products, Specifications, and Compatibility
EVCO USA makes reasonable efforts to provide accurate product descriptions, photographs, dimensions, specifications, compatibility information, features, certifications, packaging details, and availability. Product appearance, packaging, software screens, firmware features, and specifications may change because of product revisions, manufacturing updates, or supplier changes.
Before purchase and installation, customers are responsible for reviewing the applicable product information and confirming suitability for the intended use, including connector type, voltage, amperage, electrical-service capacity, panel capacity, circuit requirements, network requirements, vehicle compatibility, installation conditions, and local requirements.
Product recommendations, compatibility information, installation kits, and panel-related kits are intended to simplify product selection and sourcing. They do not replace a site-specific evaluation by a qualified electrician or other qualified professional where one is required.
4. Orders and Order Acceptance
All orders are subject to acceptance, payment authorization, product availability, shipping eligibility, and verification. An order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.
EVCO USA may refuse, limit, hold, or cancel an order for legitimate reasons, including inventory shortages, suspected fraud, payment-verification issues, pricing or listing errors, shipping restrictions, legal requirements, unusually large quantities, resale concerns, or misuse of a promotion.
If EVCO USA cancels a paid order before shipment, the applicable amount will be refunded to the original payment method. Customer-requested changes or cancellations may not be available after an order has entered processing or shipped.
5. Pricing, Taxes, and Payment
Prices are stated in U.S. dollars unless otherwise indicated. Applicable sales tax, shipping charges, service fees, financing charges, and other disclosed charges may be added during checkout.
Payment must be successfully authorized before an order is processed. Transactions may be handled by third-party payment processors, banks, financing providers, or other financial-service providers, whose separate terms and privacy notices may apply.
EVCO USA may correct pricing, typographical, calculation, or product-listing errors. If an error affects an order, EVCO USA may request approval of corrected terms or cancel and refund the affected order.
6. Shipping and Delivery
Shipping methods, processing estimates, delivery estimates, shipping charges, damaged or lost shipments, refused deliveries, incorrect addresses, failed delivery attempts, and related matters are governed by the current EVCO USA Shipping & Delivery Policy.
Delivery dates are estimates unless expressly stated otherwise. When an order cannot be shipped within an applicable promised timeframe, EVCO USA will handle delay notices, cancellation options, and refunds in accordance with applicable law.
7. Returns, Refunds, and Exchanges
Return eligibility, non-returnable products, exchanges, restocking fees, return-shipping responsibilities, packaging requirements, refunds, and return authorization procedures are governed by the current EVCO USA Return & Refund Policy.
A return authorization or return label permits a product to be sent to EVCO USA for evaluation. It does not by itself guarantee approval of a refund, replacement, repair, exchange, warranty claim, or other remedy. Eligibility may be confirmed after receipt and inspection.
8. Limited Warranty
Warranty coverage, exclusions, available remedies, service procedures, and claim requirements are governed by the written warranty applicable to the specific product.
Where EVCO USA or a manufacturer provides a written consumer warranty, the applicable warranty terms should be reviewed before purchase. Nothing in these Terms limits a warranty, right, or remedy that cannot legally be excluded or limited.
9. Installation, Electrical Safety, and Product Use
EV charging equipment and electrical-infrastructure products must be selected, installed, connected, commissioned, operated, and maintained in accordance with product instructions, manufacturer specifications, applicable laws, electrical codes, permit requirements, utility requirements, and safety notices.
Where required by law, code, product instructions, or the nature of the work, installation must be performed by a qualified or licensed electrician. The customer and installer are responsible for confirming site conditions, electrical-service capacity, panel capacity, wiring, grounding, circuit protection, conductor sizing, connector type, network connection, and vehicle compatibility.
EVCO USA is not responsible for loss, damage, injury, failed inspections, code violations, charging interruption, or additional costs caused by improper installation, incorrect product selection, misuse, unauthorized modification, incompatible equipment, failure to follow instructions, or work performed by an independent installer, except to the extent responsibility cannot legally be excluded.
10. Installation Kits, Panel Upgrade Kits, and DLM Solutions
Installation kits and panel upgrade kits are assembled or offered to simplify sourcing of commonly needed components. Actual project requirements vary by property, electrical system, equipment, local code, utility rules, and permitting authority. A kit may not contain every item required for a particular installation.
Dynamic load management and power-balancing products must be configured and installed according to the applicable instructions and site conditions. EVCO USA does not guarantee that a DLM or power-balancing solution will eliminate the need for an electrical-service or panel upgrade in every installation.
11. OCPP Chargers and Connected Features
Certain EV chargers may support Open Charge Point Protocol (OCPP), remote management, networking, firmware updates, charging-session data, access controls, or other connected features. Availability depends on the charger model, firmware, configuration, network connection, third-party platform, and service arrangement.
Unless EVCO USA expressly provides a hosted network or software service under a separate written agreement, EVCO USA does not guarantee the availability, functionality, pricing, or performance of third-party OCPP platforms, network providers, payment systems, cellular services, or cloud services.
Connected features may occasionally be unavailable, delayed, interrupted, limited, or changed because of updates, maintenance, network conditions, cybersecurity measures, utility events, third-party outages, or circumstances outside EVCO USAβs reasonable control.
12. Independent Installers and Third-Party Contractors
Electricians, installers, contractors, dealers, service providers, and other professionals who are not EVCO USA employees are independent third parties. Their estimates, schedules, workmanship, licensing, permits, insurance, pricing, and contractual obligations are their own responsibility unless EVCO USA expressly agrees otherwise in writing.
Any installation or service agreement between a customer and an independent installer is separate from these Terms.
13. Accounts and Account Security
Customers must provide accurate, complete, and current information when creating an account, placing an order, registering a product, or requesting service. You are responsible for protecting passwords, payment information, activation credentials, devices, and other account-access methods.
Notify EVCO USA promptly if you believe an account, product registration, payment method, activation credential, or other access method has been used without authorization. EVCO USA may require identity or ownership verification before making account or registration changes.
14. Acceptable Use
You may not use EVCO USA websites, products, software-enabled features, or services to:

Β·Β Β Β Β Β Β Β Β attempt unauthorized access to an account, charger, network, software, server, or data;
Β·Β Β Β Β Β Β Β Β upload malicious code, bypass security controls, or interfere with service operation;
Β·Β Β Β Β Β Β Β Β misrepresent identity, ownership, eligibility, or authority to use a product, account, payment method, or warranty service;
Β·Β Β Β Β Β Β Β Β copy, scrape, reverse engineer, resell, or commercially exploit protected software or content except where authorized by law or EVCO USA in writing; or
Β·Β Β Β Β Β Β Β Β infringe the intellectual-property, privacy, contractual, or other rights of EVCO USA or another party.
EVCO USA may restrict or suspend access when reasonably necessary to protect customers, systems, safety, legal compliance, or service integrity.
15. Intellectual Property
EVCO USA names, logos, website content, product materials, documentation, text, graphics, interfaces, and other proprietary content are owned by EVCO USA or used under license and are protected by applicable intellectual-property laws. Third-party brand names, including EVGREEN and vehicle-manufacturer trademarks, remain the property of their respective owners.
Except as expressly permitted in writing or by law, you may not copy, modify, reproduce, publish, distribute, sell, license, reverse engineer, remove ownership notices from, or create derivative works from protected content, software, firmware, or product designs.
16. Customer Content and Communications
If you submit reviews, photographs, videos, installation images, troubleshooting information, feedback, or other content, you represent that you have the right to provide it and that doing so does not violate another personβs rights.
You grant EVCO USA a non-exclusive, worldwide, royalty-free license to use submitted content as reasonably necessary to process an order, investigate a claim, provide support, administer a warranty, improve products and services, comply with law, or publish a review when you have chosen to submit it for publication.
17. Privacy
EVCO USAβs collection, use, disclosure, retention, and protection of personal information are governed by the current EVCO USA Privacy Policy. Connected products may generate technical information such as charger status, firmware information, connectivity status, session information, error codes, or diagnostic data, depending on the product and service configuration.
18. Third-Party Products and Services
EVCO USA products and services may interact with independent installers, payment processors, shipping carriers, utilities, vehicles, software platforms, networks, mapping services, mobile-app stores, and other third-party products or services.
Third-party products and services are governed by their own terms, warranties, service levels, and privacy practices. EVCO USA is not responsible for independent third parties except to the extent required by applicable law.
19. Disclaimers
Except as expressly stated in an applicable written warranty and to the fullest extent permitted by law, the EVCO USA website, software-enabled features, and services are provided on an βas availableβ basis. EVCO USA does not guarantee uninterrupted connectivity, error-free third-party software, continuous availability of external networks, or compatibility with every vehicle, electrical system, device, network, or third-party platform.
Product warranties are governed by the applicable written warranty. Nothing in these Terms excludes or limits any implied warranty, statutory right, product-liability right, or consumer remedy that cannot lawfully be excluded or limited.
20. Limitation of Liability
To the fullest extent permitted by law, EVCO USA will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages arising from the website, an order, a product, or a service, including lost profits, lost revenue, lost data, loss of use, charging interruption, business interruption, towing costs, rental-vehicle costs, travel costs, or third-party expenses.
Except where a different limitation is required by law or stated in an applicable written warranty, EVCO USAβs total liability arising from a product, order, website, or service will not exceed the amount paid to EVCO USA for the specific product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations or exclusions. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless EVCO USA and its affiliates, officers, employees, agents, and service providers from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use, misuse, unauthorized modification, violation of these Terms, violation of applicable law, or infringement of another partyβs rights. This provision does not apply to the extent prohibited by applicable consumer law.
22. Events Beyond Reasonable Control
EVCO USA is not responsible for delay or failure caused by events outside its reasonable control, including severe weather, natural disasters, fire, utility failure, transportation interruption, labor disputes, government action, customs delay, supply shortage, cyberattack, telecommunications outage, epidemic, or similar events. When practical, EVCO USA will make reasonable efforts to communicate material delays and resume affected services.
23. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Before filing a formal dispute, customers are encouraged to contact EVCO USA so the parties can attempt to resolve the matter. Any dispute that is not resolved informally may be brought in a court of competent jurisdiction, subject to any non-waivable rights or venue protections provided by applicable law.
These Terms do not require mandatory arbitration and do not waive any right or remedy that cannot lawfully be waived.
24. Related Policies and Order of Precedence
These Terms should be read together with the current EVCO USA Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy, and applicable Limited Warranty.
Each policy governs its specific subject matter. If there is a conflict, the document that more specifically governs the issue will control, unless applicable law requires otherwise. An order confirmation, written sales agreement, product-specific warranty, dealer agreement, or service agreement may contain additional terms for that transaction or relationship.
25. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law. EVCO USAβs failure to enforce a provision does not waive its right to enforce that provision later.
26. Electronic Communications
EVCO USA may provide order confirmations, shipping notices, policy disclosures, warranty communications, account messages, and other records electronically through email, the website, or another electronic method you provide. Electronic communications satisfy any requirement that a communication be in writing except where applicable law requires another method.
27. Changes to These Terms
EVCO USA may update these Terms to reflect changes in products, services, operations, technology, business practices, or legal requirements. The current version will be posted on evco-usa.shop with an updated effective date. Unless otherwise stated or required by law, changes apply prospectively from the stated effective date.
